The University of Oregon (UO) and Dynamic Measurement Group (DMG) have amicably settled a dispute regarding the copyright and trademark ownership of the Dynamic Indicators of Basic Early Literacy Skills (DIBELS®) and Indicadores Dinámicos del Éxito en la Lectura (IDEL®) assessments. The settlement includes agreements by other named parties to the dispute, as well as DMG publishers, Amplify Education, Inc. and Cambium Learning Group Inc.
As part of the settlement, UO has purchased from DMG the DIBELS and IDEL trademarks, along with ownership of the copyrights to the DIBELS 6th edition and IDEL 7th edition materials. DMG has retained the ownership of the copyrights to the DIBELS Next materials. The University has licensed the trademarks to DMG and its publishers for a transition period in order to help ensure access to the current DIBELS and IDEL assessments and to support the schools, districts and states that utilize the current DIBELS and IDEL assessments. Following the transition period, DMG will continue to distribute its assessment currently called DIBELS Next with a new name, and UO will release its new assessment under the DIBELS 8th Edition brand.
Amplify is entering into a partnership with UO to offer the new DIBELS 8th Edition, to be launched on their mCLASS platform on a future date to be announced. Amplify will also continue to offer the current DIBELS Next content from DMG on its mCLASS platform.
“The University of Oregon appreciates and acknowledges the contributions of Dr. Roland Good and Dr. Ruth Kaminski in the creation of the DIBELS and IDEL marks and products and their authorship in the DIBELS Next, DIBELS 6th Edition, and prior versions of the DIBELS assessments. We are all pleased that the teachers and administrators that depend on DIBELS and IDEL to support the literacy development for millions of students nationally will be able to easily continue utilizing the assessments this school year and beyond.”
