The use of the Acadience Training materials by Acadience Mentors is subject to an educational use agreement. Please read the agreement below carefully and click the checkbox to accept the terms.

Terms and Conditions for Use of DMG Acadience Training Materials

I certify that I am the person [(“User”)] authorized by Dynamic Measurement Group, Inc. (“DMG”) to use the password to gain access to the password-protected training materials that are available to me on this site (“Training Materials”) and I agree to the following terms and conditions of use with respect to the Training Materials (“Use Agreement”):

1. User may use the Training Materials only for the following purposes, and User will not use the Training Materials for any other purpose without prior written approval from DMG:
    
   Use within the Agency (Non-Commercial Use)
   User may use the Training Materials to train other educators within the school, school district or other educational organization at which User is employed (“Agency”) to administer, score, and interpret Acadience assessments (“Non-Commercial Use”). User acknowledges that this permitted Non-Commercial Use within the Agency does not authorize User to use the Training Materials to, among other things, train other Acadience trainers or Mentors.

 
The Training Materials may include a sample of handouts approved for training session participants; User will not in any event make handouts for training session participants by copying or otherwise reproducing these or other materials from the Training Materials without prior written approval from DMG. Note: Users may purchase training books (with handouts for training session participants) by contacting info@acadiencelearning.org; if the Non-Commercial User is unable to or does not wish to purchase training books, contact info@acadiencelearning.org for other possible options.

Use outside the Agency (Commercial Use)
User may use the Training Materials to train persons not employed by User’s Agency to administer, score, and interpret Acadience assessments (for example, User may provide training to persons employed by schools, districts, and other educational agencies other than User’s Agency or provide other training workshops with registrations open to the public) (“Commercial Use”). User acknowledges that this permitted Commercial Use outside the Agency does not authorize User to use the Training Materials to, among other things, train other Acadience trainers or Mentors. In addition, for any Commercial Use: (a) the User may only use the then-current version of the Training Materials posted on this website, and (b) User will not allow any other individual to use the Training Materials (whether as an employee or contractor of User or otherwise) unless that individual has also completed a DMG-sponsored Mentor training session with respect to the Training Materials.

For Commercial Use, the User must also purchase Acadience training books for training session participants (training books include all necessary handouts), unless training books are unavailable or another arrangement is approved in advance by DMG. The Training Materials may include a sample of handouts approved for training session participants; User will not in any event make handouts for training session participants by copying or otherwise reproducing these or other materials from the Training Materials without prior written approval from DMG. 2. The Training Materials may not be altered or incorporated into or compiled with other materials, either in whole or in part, by any means, electronic, print, or otherwise, without the prior written permission of DMG. Alteration includes, but is not limited to, changes to font, sequence, content, or the removal of the words “Dynamic Measurement Group.” No part of the Training Materials may be used to make other works based, in whole or in part, on the Training Materials.

 

3. The Training Materials may not be copied, distributed, displayed, or reproduced in any format or media (e.g., print, DVD, web pages) without the prior written permission of DMG.

 

4. The provisions of the preceding paragraph to the contrary notwithstanding, User may: (a) print a paper copy of the Training Materials for User’s own use in preparing for and providing training within the scope of use authorized above in Section 1; (b) User may download the Training Materials onto the computer that User uses to conduct training within the scope of use authorized above in Section 1, and (c) User may display the PowerPoint slides contained within the Training Materials in the course of training within the scope of use authorized above in Section 1.

 

5. The User will take all necessary and appropriate action to safeguard the Training Materials from any use that is not permitted by this Use Agreement (including but not limited to sale and/or commercial distribution) and will immediately notify DMG if the User becomes aware that the Training Materials have been sold or commercially distributed or otherwise used in a manner that is not authorized by this Use Agreement.

 

6. The User may use the Training Materials pursuant to this Use Agreement for a period of five (5) years from the date of the User’s completion of the DMG-sponsored workshop that is associated with the password giving User access to the Training Materials. After such five (5) year period, all rights of the User in and to the Training Materials will expire; the provisions of Sections 2, 3 and 5 will survive such expiration.

 

I agree to the above statements and conditions and will provide the necessary safeguards to protect DMG’s property and copyright.
